ARCEP publishes its market analysis decision on wholesale capacity services on inter-territorial segments in the overseas collectivity of Saint-Barthélemy.

On 1st September 2011, ARCEP adopted its market analysis decision on wholesale capacity services on inter-territorial segments in the overseas collectivity of Saint-Barthélemy, which will come into effect for a period of three years upon its publication in the "Journal officiel".

After having received a positive response from the Competition Authority concerning the Saint-Barthélemy market, and having taken account of the Competition Authority's remarks relating to the Saint-Martin market, along with the European Commission's comments and contributions from the sector's stakeholders which were received prior to 1st August, on 1st September 2011 ARCEP issued its final decision on its analysis of the wholesale market for wholesale capacity services on inter-territorial segments in the overseas collectivity of Saint-Barthélemy.

In it, the Authority states that this is a relevant market for ex ante regulation and designates Global Caribbean Network as the operator that enjoys significant market power (SMP), as a result of which it is subject to several obligations, including cost-based pricing for its services.
