ARCEP submits the draft decision relating to its analysis of fixed telephony markets to the European Commission.

Today ARCEP is submitting its draft decision relating to its analysis of fixed telephony markets to the European Commission. The Commission then has until 11th July 2011 to communicate its remarks to ARCEP. The draft decision is also being submitted to a public consultation that will run until that same date - after which ARCEP will adopt its final decision that will apply to the years 2011 to 2014.

ARCEP submitted the first version of its "Market status and outlook" document and of its market analysis to a public consultation that ran from 23rd February to 23rd March 2011. Nine parties responded to this consultation. With the exception of those protected by business secrecy, these responses along with a summary were made public on 15th April 2011.

That same day, the revised market analysis was submitted to the French Competition Authority for feedback. This opinion, which was issued on 27th May 2011, is being made public today.

ARCEP then produced a draft decision based on this opinion. This is the draft document that is being submitted today to the European Commission and to national regulatory authorities in the other EU Member States.

It is also being submitted to a public consultation, inviting all of the sector's stakeholders to comment on the entire document. Responses to the consultation must be sent to ARCEP, preferably via e-mail - to adm.telephoniefixe(@)arcep.fr - by 5 p.m. 11th July 2011.

ARCEP will adopt its final decision in July, after having taken the utmost account of the remarks made by the European Commission, European Union NRAs and of the responses to the public consultation.
