ART notifies to the European Commission its analyses of the wholesale market for unbundled access and the wholesale market for broadband access delivered to alternative operators at the regional level. It also launches a public consultation on the wholesale market for broadband access offers delivered at the national level

  • Wholesale market for unbundled access and wholesale market for broadband access delivered to alternative operators at the regional level

As part of its broadband market analysis process, Autorité de Régulation des Télécommunications (ART) notified today to the European Commission its draft decisions regarding the delimitation of the following relevant markets:

- local loop unbundling
- wholesale broadband access offers delivered at the regional level

ART has designated these two markets as relevant for ex ante regulation and has identified France Telecom as having significant market power on these markets. As a result, its draft decisions define the proportionate obligations to be imposed on France Telecom in coming years.

At the same time, ART is also submitting its draft decisions to a public consultation from Wednesday 13 April to Friday 13 May at noon, at the latest. ART will carefully consider all comments made by the Commission, national regulatory authorities and market players before adopting its final decisions.

  • Wholesale market for offers delivered to Internet access providers (IAPs) at the national level

Following the opinion issued by France's competition council, Conseil de la concurrence, on 31 January 2005 regarding broadband market analyses, ART has defined the obligations which should be imposed on France Telecom under the regulation of the wholesale market for broadband offers delivered at the national level.

As a result, the obligations proposed at this time (discussed in a public consultation in the summer of 2004) are significantly different from those which had been originally considered by ART.

Therefore, ART is now submitting its new draft decision (covering the obligations imposed on France Telecom as operator with significant power on the wholesale market for broadband access delivered at the national level) to a public consultation, prior to submitting it to the Commission.

Players are invited to share their reactions before Friday 13 May at noon, at the latest.
