In letters dated 17 November 2000, 22 November 2000 and 29 November 2000, Autorité de régulation de télécommunications (ART) was requested to sanction France Telecom under article L. 36-11 of the Post and Telecommunications Code, because of its failure to provide the information needed to implement access to the local loop, an obligation which is stipulated in the second-to-last paragraph of article D. 99-23 of the Post and Telecommunications Code.
France Telecom presented its observations during the examination of the requests conducted in accordance with article 18 of ART's internal regulations.
After having heard the reporter, ART considered that France Telecom had not respected its obligation to provide the information needed to implement access to the local loop and ordered it to do so in accordance with the conditions established in its decision no. 00-1326 dated 14 December 2000.
